1.1 The "Shoulder To Shoulder Tool" app (hereinafter the "APP") is intended to make available updated and complete commercial and technical information (hereinafter the "Information") regarding Iveco S.p.A. products (hereinafter "Iveco").
1.2 Unless otherwise indicated, the contents of the APP, data, news, information, images graphics, designs, photos, videos, trademarks, domain names and other are the property of Iveco and protected by copyright and industrial property laws.
2.1 By downloading, installing and using the APP, the user agrees to be bound by the following terms and conditions and also by any modifications made thereto by Iveco. To access the services and use the APP, the user will be required to provide his/her identification data.
2.2 Iveco grants the user a non-transferable and non-exclusive right and license to use the APP. The user undertakes not to carry out, directly or indirectly, any of the following activities: copy, modify, create derivative works from the source code, decode, disassemble or attempt in any other way to discover such code, to sell, transfer, sublicense or otherwise transfer the APP or part of this and also any right to and in the APP.
2.3 The user undertake to use the Information furnished by the APP only for purposes tied to working activities carried out on behalf of Iveco. The user is not granted any license to use the Information on his/her own behalf and it is, therefore, forbidden to record the Information on any type of support, to reproduce, copy, publish and use this for purposes other than those indicated above without the prior written authorization of Iveco.
2.4 Unless otherwise indicated, the information contained in the APP is produced by Iveco which has the right, at any time and at its discretion, to modify the contents and methods of functioning and operation of the APP without prior notice.
2.5 In the case of disposal or assignment to third parties of the electronic device the user uses to access the APP, he/she must always remove the APP from his/her electronic device.
3.1 Iveco reserves the right to modify, suspend or interrupt the services provided via the APP, or part thereof, at any time without prior notice. The user agrees and accepts that Iveco will not be liable to him/her or to any third party for any modification, suspension or interruption of functioning of the APP.
3.2 The user declares to acknowledge and accept that Iveco does not warrant or guarantee (i) that the APP meets his/her specific requirements, (ii) that the APP is without malfunctions or free of errors, (iii) that the quality of any Information, service or material obtained via the APP meets his/her requirements.
3.3 The user acknowledges and expressly accepts that Iveco will not be liable to him/her for any direct or indirect or other damage including, for example purposes only, loss of profit deriving from or in any way connected to his/her use of the APP.
3.4 While all reasonable care has been dedicated to ensuring that the information contained in the APP is reliable, precise, accurate and up-to-date, Iveco assumes no responsibility or liability for any errors, inaccuracies, omissions in the contents published deriving from material or typographical errors, insertion of data, formatting, scanning or other.
3.5 Iveco shall not be liable for malfunctions of the APP, delay in updating the Information or for damages caused by any interruptions, suspensions, delays or irregularities in the connection to the APP, regardless of how caused.
3.6 Iveco protects the APP against the risk of intrusion and the action of programs intended to damage or interrupt functioning thereof through adoption of specific tablets and anti-virus systems. This does not imply any liability on the part of Iveco for cyber attacks on the servers that manage the APP, improper use thereof and computer crimes committed by third parties that may damage the APP, compromise the Information contained therein or damage the user’s tablet. The user is solely responsible for equipping his/her tablet, used for connection to the APP, with programs and systems able to guarantee secure navigation on telematic networks and suitable protection against viruses and other harmful programs.
4.1 By installing the APP, the user agrees and accepts that Iveco may process some of his/her personal data (email address) in full compliance with the principles established by Legislative Decree 196/03 "Code on the protection of personal data" ("Code"). The user acknowledges that use of the APP may involve the transmission of data on electronic communication networks.
4.2 Iveco shall not be liable for any loss or damage deriving from the processing of such data. More detailed information regarding how Iveco uses personal data can be found on the www.iveco.it site. The Data Controller is Iveco S.p.A. with registered offices in Turin, Via Puglia 35.
